1. Acceptance
These Terms & Conditions (“Terms”) govern your use of the EVART ENERGY mobile app and related services (the “Service”), provided by [EV ART ENERGY] (“EVART ENERGY,” “we,” or “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service.
3. Your Account
You are responsible for the accuracy of your account information and for keeping your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Charging Sessions
The Service lets you locate charging stations and start and stop charging sessions. Charger availability, power output, and pricing are set by the location or partner operator and may change without notice. You are responsible for using charging equipment safely and following all posted instructions and applicable laws.
5. Payments, Wallet & Pricing
Charging is billed based on the session details (such as energy delivered, time, or applicable fees). Payments are processed through our payment provider, Stripe. If your account uses a prepaid wallet balance, charges are deducted from that balance. Prices are shown before or during a session where available. Except where required by law, completed charging sessions are non-refundable.
6. RFID Cards
If you link or claim an RFID card, you are responsible for its use and for any sessions started with it. Report lost or stolen cards promptly so we can disable them.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful or fraudulent purpose.
- Tamper with, damage, or interfere with charging equipment or the Service.
- Attempt to gain unauthorized access to the Service or other users’ accounts.
- Resell or misrepresent the Service without our permission.
8. Third-Party Locations
Many charging locations are owned and operated by independent partners and operators. We are not responsible for the condition, availability, or safety of equipment we do not own or control.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not guarantee that chargers will be available, that the Service will be uninterrupted or error-free, or that any particular charging outcome will be achieved.
10. Limitation of Liability
To the maximum extent permitted by law, EVART ENERGY and its partners will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or vehicle or battery damage, arising out of or relating to your use of the Service. Our total liability for any claim is limited to the amount you paid us for the charging session giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless EVART ENERGY and its partners from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or use the Service in a way that may cause harm or legal liability. You may stop using the Service at any time.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of United States, without regard to its conflict-of-laws rules.
